Rape: Don advocates effective legal action

Zaria (Kaduna State), Aug. 26, 2019 (NAN) Dr Abdulhamidu Abdullahi of Department of Local Government and Development Studies, Ahmadu Bello University (ABU), Zaria, has advocated for proper legal action to curb recurrence incidents of rape in the country.
He made the call in an interview with the News Agency of Nigeria (NAN) on the sideline of “Annual NGO Orientation Summit 2019’’, on Monday at the Faculty of Administration, ABU, Kongo, Zaria.
The programme was organised by the Department of Local Government and Development Studies, Faculty of Administration, ABU, Zaria.
Abdullahi, who is also a lecturer on NGOs as a course study, observed that sometimes the legal angle was a problem in itself in Nigerian context, adding that some judgments were usually overturned.
“In the case of ABU, we are very happy the university had been very proactive but the issue is that there is always the legal angle that we are always getting into trouble with.
“At times when a rape case is taken to court and the judgment is overturned, this is a big challenge to all, so it is not just the university but the whole community that will have to stand up.
“Both the judiciary, the legislature and the executive must be up and doing and most importantly, parents and guardians must do the needful to curtail this problem,” he said.
Abdullahi said the summit was organised as a result of an assignment given to his students particularly on NGO.
“We are here because of the assignment I gave my students; that they should do a prototype NGO and one of the NGO is the one handling this advocacy today while other students sweep the environment.
“Others clean the toilets in the department while others contribute writing materials that they will be given to students on this occasion all in the spirit of showing students that there is need for volunteerism in life because people need assistance.
“No matter how big or small you are, you need assistance, so, NGOs are meant to assist and improve people’s life not because people are incapable but they need some support from NGOs because NGOs do certain things that government and other individuals could not be able to do,” he said.
On the goals of the summit, the don listed them to include: Sensitising both the lecturers and students to know that rape is a very serious and sensitive issue, and enlightening the participants on the counter-productive effect of rape in the society, adding that such negative effects include people trying to commit suicide.
He also said that the summit sought to highlight both the economic and socio-political implications of rape, assuring that if the society is well informed about such implications then it will be more proactive in preventing the menace.
The Dean, Faculty of Administration, Prof. Bashir Jumare, also said cases of rape among students were so alarming particularly in academic environment across the country.
Jumare, who doubled as the Head of Department, Local Government and Development Studies, observed that the university had witnessed several cases of sexual harassment.
He stressed the need for the authorities in different universities to address the topical issues associated with rape menace else it would definitely and negatively affect the entire education sector.
The dean said the programme sought to sensitise both members of the academia and students to understand that rape had remained a criminal issue that needed collective efforts to end it.
Jumare said the department also billed students into thorough study of social vices such as domestic violence, illicit drugs and child labour, among others, with a view to proffering solutions to the problems.
The Guest Speaker at the occasion, Ms Oluwa Sewun-Ayodeji, expressed regret over the recurrence of rape cases especially in the academic circle.
Sewun-Ayodeji, an ex-student of the department, who is also the Executive Director, “Stand to End Rape Initiative”, an NGO, spoke on “Rape and Sexual Harassment in Tertiary Institutions in Nigeria”.
She said the NGO was advocating to end sexual violence, gender-based violence and providing support services to those who have been raped.
She said: “We work with local and national agencies to create solutions to the issue of gender based violence in Nigeria.
“The good thing about ABU is we have a gender desk, which means we have a desk where in case of sexual harassment you can report.
“I will be working with that department to enhance its capacity to create awareness on campus about sexual harassment and rape, and also ensure that every student has access to the policy brief.
“Because every university should have a sexual harassment policy, so, if we currently have one we need to review it to ensure that it is functional and students can actually read about their rights in a policy brief and have more understanding of where they can report.”
On judicial laxity, the guest speaker said her NGO would not be able to do the work alone, stressing the need for collaboration with other civil society organisations to effectively address the challenge.
“We can’t do it alone, we have to work in collaboration with other CSOs to ensure that once our case gets that kind of platform and with concrete evidence the Supreme Court never overrule a decision.
“If we are able to present and proof beyond reasonable doubt where the lecturer is guilty, because court needs evidence not just emotions Supreme Court will definitely convict the person.
“This summit is just an aspect because our audience is students, that is why I am focusing more on students, our work actually covers universities, secondary schools and even anyone in the society who is being harassed or who has been sexually violated,” she said. (NAN)

Zazzau Emir laments frequent cases of rape of minors

Zaria (Kaduna State), Aug. 13, 2019 (NAN) Dr Shehu Idris, the Emir of Zazzau and Chairman, Kaduna State Council of Emirs and Chiefs, has frequent cases of rape of minors in the society.

Idris said this on Tuesday in Zaria while addressing his subjects, who converged at his palace to pay their Sallah homage, traditionally called “Gaisuwan Sallah”.

The News Agency of Nigeria (NAN) reports that “Gaisuwan Sallah” is an ancient tradition where the subjects gathered at the palace to thank Almighty Allah, for a successful celebration and to show solidarity, respect and love to the Emir.

The first class traditional ruler, who spoke through the Iyan Zazzau, Alhaji Bashar Aminu, said: “The rampant cases of rape is alarming and the worst of all, is raping of minors in our society today.

“We are Muslims and Islam forbids adultery and is totally against rape. So, as Muslims we must be guided by the tenets of Islam, raping is alien to us as a society.

“Islam teaches good moral virtues, it kicks against any form of immorality of whatever form, we must abide by all rules and regulations governing our religion to be able to live in peace,” he said.

The Emir advised his subjects, especially beneficiaries of agriculture loan scheme, to redouble efforts towards repayment, to enable others benefit from the scheme.

He observed that other Nigerians would only benefit from the loan when beneficiaries refund what they have collected.

“If you collect the loan with the intention of paying back, Almighty Allah will certainly open way for you to refund, but those who collected with no intention of paying back will not have the means to pay back.

“You should not allow yourselves to be left behind, endeavour to collect the loan. Government has introduced several loan schemes and earmarked huge amount for such schemes.

“Kindly collect the money with the intention of paying back and practice farming as a business. Definitely Almighty Allah will give you the means and ability to pay back and become a great farmer,” he said.

The royal father also advised farmers to report any security challenges, especially those that were threatening their farming business.

He said when such incidences were reported on time, necessary security measures would be put in place to ensure that they practice their farming business peacefully and accordingly.

Idris called on government to redouble efforts towards early provision of agricultural inputs, adding that fertiliser had become a critical element in recording bumper harvest.

The Emir advocated the establishment of more cottage industries in Zazzau Emirate and Kaduna state at large to create jobs and curb youths restiveness.

This, according to him, will create more job opportunities for not only the younger ones but also the teeming unemployed citizens roaming the streets.

He expressed satisfaction with the establishment of three new fertiliser blending plants in the state, assuring that the new plants would reduce overdependence on foreign firms for the commodity.

Idris encouraged his subjects to go into different businesses, adding that banks are directed by the federal government to disburse loans to enable people participate in businesses to eradicate poverty.

On frequent accidents on Abuja-Kaduna-Zaria-Kano Expressway, the Emir pleaded with motorists to exercise some degree of caution while on driving.

He observed that most of the accidents on the highways were as a result of impatience and desire to reach destination quickly.

The monarch, however, said ongoing road reconstruction was not meant to cause any havoc on people, but it was being carried out in good faith to provide a platform for smooth vehicular movement on the expressway.

While appreciating his subjects for the prevailing peace in the area, the Emir also urged them to support the present administration at all levels to enable them benefit more from dividends of democracy. NAN)

NGO expresses concern over rising cases of rape among teenagers

Bichi (Kano State), July 14, 2019 (NAN) A Kano-based NGO, Public Defenders Office, which provides free legal services to the less-privileged, has expressed concern over the rising cases of rape among women most especially teenagers.

The Administration Officer of the organisation, Mrs Rotkang Kuynnia, said this at a one-day campaign organised to sensitise the public at Hagagawa primary school in Bichi Local Government Area of Kano State on Sunday.

She said the issue of rape among teenagers was becoming worrisome and must be fought to an end.

Kyunni said providing free legal services to the less-privileged was necessary in order to ginger their confidence that they have what it takes to claim their inalienable rights legally.

According to her, the Public Defenders Office had been working hard to ensure that the rights of the down trodden was not trampled upon with impunity.

“With the free legal services being offered by the office, many intractable cases and family disputes were settled either through amicable consultation or legal means.

“We are here to sensitise the public on what really constitutes one’s fundamental human rights and seek ways and means to fight for it.

“We understand that many people are ignorant of what constitutes their rights under the law. We want them to understand and forge ahead with what is supposed to be done in waging the crusade,” she said.

She urged all those with genuine complaints to go to their office in Kano and lodge complaint as they had been receiving cases of gross human rights violations from those who felt oppressed.

“We are always attending to them and we have recorded tremendous achievements in that regard. The issue of rape among women, most especially teenagers, is becoming a disturbing phenomenon and we must rise against it,” she said.

She said stemming the tide of rape cases was the responsibility of parents, traditional rulers and security agencies,adding we must all get prepared to face the task.

“When we receive complaints of despicable sexual abuse, we are ready to take it up legally. the law will take its course against any culprit found to have committed such heinous act,” she added.

She, therefore, called on traditional rulers and elders in the area to rise up to the challenge in order to stop oppressing and victimising the less-privileged in the siciety.(NAN)

Rape: Senate to review laws to provide stiffer penalties

Abuja, July 9, 2019 (NAN) The Senate on Tuesday passed some resolutions to review relevant laws that will provide for stiffer sanctions for perpetrators of rape in the country.
The decision of the senate followed a motion of urgent public importance, sponsored by Sen. Rose Oko (PDP-Cross River North), titled “Rising incidence of rape of minors”.
The senate also directed its committees on Judiciary, Police Affairs, Women Affairs and Social Development, when reconstituted, to interface with relevant stakeholders to strategise on implementation of all legislations and policies aimed at protecting minors from rapists and other forms of violence.
The senate also directed the committees to review relevant legislations with a view to providing stiffer penalties against sexual abuse of minors in the country.
It further urged the Police and other law enforcement agencies to conduct mandatory training for officers in dealing with rape cases and young victims of abuse.
It also urged the Judiciary to establish national sentencing framework for child sexual abuse cases and judicial officers, to impose stiffer penalties on perpetrators of all forms of abuses against minors.
The lawmakers further urged state governments to domesticate and implement the Child Rights Act and Violence Against Persons Prohibition Act 2015, to curb the issues of sexual abuse of minors.
Furthermore, it urged the general public to continue to act as watchdogs to curb child sexual abuse and other forms of violent abuse.
Oko, who brought the motion through Orders 42 and 52 of the Senate Rule, said the rising incidences of rape of infants and minors in parts of the country are worrisome.
She said that six out of every 10 Nigerians were being raped on daily basis.
The lawmaker noted the shocking rape story of a six-month old baby in Kano and other cases of students being raped by their teachers and lecturers in the nation’s institutions were issues of concern to the parliament.
She lamented that law enforcement agencies had not lived up to their responsibilities in checking the increasing wave of rape in the country.
She therefore called on the senate to evolve ways of providing stiffer measures to serve as deterrent to rapists.
Contributing, Sen. Oluremi Tinubu (APC-Lagos Central) also described rape of minors as extreme wickedness and called for imposition of death sentence on offenders.
The Deputy President of the Senate, Sen. Ovie Omo-Agege (APC-Delta Central), in his contribution, noted that the country had sufficient laws on rape but lacked the will power to enforce such laws.
He therefore called on the Red Chamber to review the existing laws.
Sen. Chukwuka Utazi (PDP-Enugu North) also observed that not much was being done on sex education in the nation’s public and private schools for the purpose of educating the children on steps to take when they felt prey to rapists, urging for inclusion of sex education in the education curriculum.
Sen. Chimaroke Nnamani (PDP-Enugu East) said that rape victims would suffer stigma by society and rejection by spouse.
He urged hospital authorities to have rape counselling unit to handle the victims. (NAN)

Delta Commissioner decries rising cases of rape, blames parents

Asaba, March 5, 2019 (NAN) The Delta Commissioner for Women Affairs, Community and Social Development, Mrs Omatsola Williams, has decried the rising cases of rape in the state.

Williams told the News Agency of Nigeria (NAN) on Tuesday that the trend was worrisome and many psychosocial factors were responsible for it including youths’ involvement in cult activities.

“It is just God that will save us from this trend that has come and many psychosocial factors are responsible for it.

“Even in primary schools now, children are already exposed to cult activities and the attempt to make quick money.’’

Williams said she is happy that the police and anti-cult groups were tackling the menace.

According to her, people are infuriated with the development, where parents, especially mothers have failed in the area of sex education.

She said that since parents have failed to teach their teenagers about sex from the beginning, when they get such information from peer groups and friends, they work with it wrongly.

The commissioner also said that some parents were eager to send their children abroad to make quick wealth and they were not bothered whichever way the money came.

“Some parents even advise their children to move out and make money and in the process such children get pregnant.

“Indecent dressing is also one reason why rape cases are on the increase; parents should advise their children and wards against indecent dressing.

“It is not right and I must say that part of the problem is from parents,” she said. (NAN)

Dutse, Dec. 10, 2018 (NAN) The Jigawa Chapter of Human Right Network (HRN) has called for concerted effort in tackling the menace of rape in the state.

Chairman of the network, Mr Misbahu Basirka, made the call at a press conference to mark the 2018 International Human Right Day in Dutse on Monday.

“As you are aware, Jigawa is one of the most peaceful states in Nigeria with less reported committed crimes.

“As human right organization, we are happy that this year’s theme is talking about “standing up for someone’s rights today and act on intimidation and reprisal”.

“The recent human rights violation Jigawa is currently experiencing is nothing than increase of rampant rape cases that are happening across the state, irrespective of gender.

“We, therefore, call on the attention of government and all stakeholders, including traditional leaders, clerics, civil society organizations, security agencies and other individuals, to join hands and address the menace,” Basirka said.

He also appealed to the state Ministry of Justice to ensure speedy trial of a Nigeria Security and Civil Defense Corps (NSCDC) personnel who allegedly shot dead one Hussaini Hassan Andaza on July 11, 2018.

“Let me remind you about the case of late Hussaini Hassan Andaza who survived with four wives and 24 children.

“You will recall that on July 11, 2018, there was a usual fracas between men of the FRSC and members of NURTW where officers of the FRSC arrested their members for violating prescribed laws.

“And that led to serious tension and disagreement between the two parties which resulted in the death of late Hussaini Hassan Andaza after being shot by a member of the NSCDC Jigawa command.

“Now the matter is before the State High Court of Justice. On this matter, we will like to appeal to the Ministry of Justice for speedy trial of this cases,” he said. (NAN)

Don advocates sexual education to curb rape, women battering

Jos, July 31, 2018(NAN) Prof. Funmi Para-Mallam, a Don at the National Institute of Policy and Strategic Studies (NIPSS), Kuru near Jos, has advocated sexual education for young boys to curb rape and wife battering in the society.
Para-Mallam, a Professor of Gender and Development Studies at the institute, made the call in an interview with the News Agency of Nigeria (NAN) on Tuesday in Jos.
She expressed worry by the incessant cases of child rape and wife battering, adding that it is important to teach the boys sex education in their formative ages to forestall child rape.
The don added that it was also important to campaign against wife battering or other forms of violence against women.
“Patriarchal entitlement mentality has affected our society; a man through culture, social inclinations and religious teachings is socialised to believe he is entitled to the female’s body at any time he desires.
“There is a need to educate them early at their various homes and schools on sexual relations that even married couples must have deterrent to this menace,’’ she said.
She explained that a woman’s bodily integrity must be respected, adding that the patriarchal entitlement mentality was contradictory to that position.
“The rights of the woman’s body and integrity as specified at the convention on the elimination of all forms of discrimination against women and under the Universal Human Rights Declaration must be respected.
“Even if a woman is walking naked, no man has the right to rape her but can prosecute her under indecent exposure, there should be no justification for this wickedness,’’ she said.
However, Para-Mallam commended the Plateau Government for gazetting the Gender and Equal Opportunity (GEO) Law in the state.
She said that it implied government was duty bound to protect and promote the rights of women and children in the state.
“It means infringement on the rights of women is judicable and will be curtailed,’’ she said.
The don said sexual discipline must be preached and educated in the society.
She also expressed worry over women who were vulnerable to sexual assault and exploit during communal attacks and in shelter camps for survival purposes.
She said the GEO Law would be successfully implemented with a good structure of competent people who are knowledgeable on gender, development, legal and project management issues, among others.
NAN reports that Plateau is the first state in Northern Nigeria to gazette the GEO law in June.
The gazette was supported by the United Nations Women in partnership with Search for Common Ground, an international body. (NAN)

FIDA seeks domestication of Justice Act to stem rape

Jos, June 19, 2018 (NAN) The International Federation of Women Lawyers (FIDA) has called on the Plateau Government to domesticate the Administration of Criminal Justice Act (ACJA) to stem domestic violence and child rape in the state.

The Chairperson of FIDA in the state, Mrs Mary Izam, made the appeal on Tuesday in Jos during a courtesy visit to the state Attorney General (AG) and Commissioner for Justice, Mr Chrysantus Ahmadu.
Izam said the advocacy was to seek the assistance of the attorney general in the amendment of the Act to fast-track its submission as an executive bill to the State House of Assembly.
She said when domesticated and enacted into law, the ACJA would enforce the protection of women and children’s rights and other issues that protects them.
“This law would ensure all accused persons in legal proceedings are assumed defendants till proven otherwise.
“The pregnant woman cannot be harmed or issued death sentence till she delivers her child and weans for six months.
“ACJA generally strives to enforce justice especially to indigent women and vulnerable children,’’ she said.
The FIDA chairperson said that the group had sought partnership with the AG’s office and the state police command because of its concern over reported incessant cases of wife battering and defilement of minors in the state.
She said that the federation had at its recent meeting with the Commissioner of Police advocated that cases of child rape should be prosecuted at the High Court for appropriate judgment instead of the lower court.
“This is because it is a capital offence in the Nigerian constitution to be handled by the High Courts.
“We are optimistic too that the gazette of the Gender Equality Opportunity (GEO) Law by the State government would protect women.
“The GEO Law prohibits all forms of violence and infringement against women rights in public and private places; eradicate socio cultural harmful practices and eliminates gender stereotyping and prejudices,’’ Izam said.
Responding, Ahmadu pledged the state’s commitment to domesticate the ACJA, saying progress is already being made on its amendment to suit the peculiarities of the state.
The commissioner said the state government would consider granting ‘fiat’ to FIDA to prosecute accused persons in matters such as rape and wife battering instead of waiting for the bureaucracy of the police. (NAN)

Dutse, June 3, 2018 (NAN) The Jigawa State Government on Sunday said it would establish additional Sexual Assault Referral Centres (SARCs) to cater for rape victims in the state.
The state’s Head of Civil Service (HoS), Alhaji Muhammad Tahir, disclosed this when he received the Country Director, Pathfinder International, Dr Farouk Mahmud, in Dutse.
Alhaji Isma’il Ibrahim, the Spokesman of the Office of the HoS, told the News Agency of Nigeria (NAN) on Sunday that the visit was an advocacy to scale up public awareness on the high rate of sexual assault in the state.
Ibrahim said that the state government had been working closely with security agencies, traditional rulers, Council of Ulamah (Islamic clerics) and other related organisations to eradicate Gender Based Violence in the state.
He added that the government would ensure timely prosecution of those involved in the menace.
He said that the state would continue to partner with Pathfinder to curb violence against women in the state.
The spokesman stated that the Pathfinder country director had earlier told the HoS that they were seeking government support to eradicate domestic violence in the state.
According to him, Mahmud noted that the Pathfinder is an NGO working towards changing and saving the lives of women and their families throughout developing countries by increasing access to essential reproductive health services.
“The Country Director further told the HoS that the U.S. Agency for International Development (USAID) through Pathfinder Nigeria is aimed at strengthening the response to Gender Based Violence in the country.
“And also by providing financial and technical assistance to already established sexual assault referral centre in the state and to support the establishment of additional ones.
“He also noted with dismay the high rate of sexual assault in the state and the country at large,” the spokesman said.
Ibrahim added that Mahmud appealed to the state government to ensure steady supply of drugs for Gender Based Violence survivors.
NAN reports that a pilot SARC was established in 2016 by Jigawa government in collaboration with the Department for International Development (DFID), under its Justice for All (J4A) programme.
The SARC was established at the General Hospital, Dutse, Dutse Local Government Area of the state.
The centre was established to provide counseling services to victims of rape by members of staff of the state Ministry of Women Affairs and Social Development.
The centre would also serve as an avenue where evidence could be established against rapists.
Also, the Jigawa State Justice Sector and Law Reform Commission said it would establish additional SARCs in the three senatorial districts of the state.
The Executive Secretary of the commission, Mr Lawan Buba, made this known in an interview with NAN in Dutse on July 31, 2017.
“As you know, rape is on the alarming rate not only in Jigawa, Nigeria, but also globally and in most cases, it is very difficult to prove such cases in court.
“So, parents of rape victims should not wash the genital part of their children until they report such incident to the police in their respective communities.
“We always tell parents of rape victims that the first point of report should be to the police.
“This is because the police are the institution responsible for taking up and processing justice on behalf of such victims by arresting, investigating and taking the perpetrator to court for trial.
“It will enable health workers to confirm the truth or otherwise of the situation when police take the victim to the hospital or health centre,’’ he said.
“At the centre a medical doctor would examine the victim and give a report which would be used against the rapist.
“Therefore, all parents or guardians of such victims should desist from keeping the matter quiet.
“Most parents keep mute thinking that they are protecting the rape victims from stigma,” Buba stressed. (NAN)

Lagos, Jan. 16, 2018 (NAN) A 27-year-old self-acclaimed medical doctor, Patrick Uzoka, who allegedly assault a patient sexually, on Tuesday appeared before an Ikeja Magistrates’ Court.
The accused, who gave no fixed address, is standing trial before Chief Magistrate O.A Layinka on a three-count charge of unlawful sexual assault, unlawful administration of drug and impersonation.
Police Prosecutor Edet Okoi told the court that Uzoka committed the offences on Aug. 19, 2017, at about 2 p.m at No. 22, Ajanlekoko St., Kirikiri area of Lagos.
Okoi said that the accused unlawfully assault a patient, (the complainant), 22, in her residence through unlawful penetration.
According to him, the accused unlawfully administered noxious substance on the victim thereby endangering her life.
“Uzoka presented himself as a medical practitioner and administered injections and other medications on the victim, (an undergraduate), who complained of stomach ache and was introduced to her by the mother who also thought he was a doctor.
“On the said day, the accused came to administer treatments on the victim who was in the company of her friend, Sarah, and he allegedly gave her an injection and she started feeling dizzy with hot sensation in her body.
“She complained to the doctor and he gave her another injection which he claimed will calm her down. He thereafter sent her friend Sarah to go get a drug for the victim claiming it was urgent.
“Immediately Sarah left, he told the victim the he has to urgently give her ‘seminal donation’ because the injection he earlier administered to her may have serious side effects to her womb.
“The accused held the victim’s hand and forcefully had sex with her and didn’t stop until Sarah the victim’s friend came knocking.
“The victim could not fight back because she was feeling dizzy and weak,” Okoi said.
According to the prosecutor, the offences contravened sections 261, 243 and 380 of the Criminal Law of Lagos State, 2015.
Chief Magistrate Layinka granted the accused bail in the sum of N1 million with two sureties in like sum.
Layinka said that the sureties must provide evidence of three years’ tax payment to the Lagos State Government and adjourned the case to Feb. 5 for trial. (NAN)
