Counsel seeks additional witness in entitlement suit
NAN-H-54
Witness
Abuja, June 29, 2017 (NAN) Mr Sa’eed Lawal, counsel to a former Branch Manager, Kotco Energy Limited, has urged the National Industrial Court, Abuja, to accommodate another witness in his suit.
His client, Mr Tanko Dauda, had dragged his former employer to court claiming that his salaries were underpaid while in the service of the company.
He further alleged that the company was yet to pay his contributory pension fund, allowances and accrued benefits after his resignation in 2014.
At the resumed hearing of the suit before Justice Edith Agbakoba, both parties were to adopt their final written addresses.
The claimant’s counsel, however, held that the law permitted him to call another witness, even at the adoption stage, to support his claims.
He insisted that the new witness would clarify issues pertaining to the salaries and outstanding entitlements in contention.
Counsel to the defendant, Mr C. Agidi, opposed the application, on grounds that it was “incompetent and misconceived’’.
Agidi urged the court not to grant the request, as it would over-reach the defendant’s case.
Justice Agbakoba, after listening to the submissions, adjourned the case until July 11 for ruling. (NAN)
